U.S. Justice Department rejects criminal enforcement of handgun sales age limit

The opinion concerns adults aged 18 to 20; it is not a court ruling.

The U.S. Justice Department announced September 18 that it considers criminal penalties unconstitutional for licensed dealers selling handguns to otherwise law-abiding adults aged 18 to 20. It relies on a new opinion from its Office of Legal Counsel. [1]

An opinion with explicit limits

Dated September 17, the opinion acknowledges divisions among federal courts. It expressly excludes age-neutral sales conditions, the prohibition on possession by people under 18 and the enhanced investigative period for purchasers under 21 from its analysis. [2]

These limits prevent the announcement from being described as the disappearance of all purchasing rules. The document addresses specific federal provisions and their criminal enforcement. It does not provide general permission to sell in every circumstance. [2]

An immediately contested decision

GIFFORDS, a gun-violence prevention organization, challenges the legality of the move and says it will oppose it. Executive director Emma Brown cites public-safety risks. These criticisms represent the organization’s position, rather than judicial findings established by its statement. [3]

Associated Press places the announcement within litigation marked by conflicting decisions. Implementation and subsequent court proceedings remain developments to watch. [4]
